Terms of Service

These terms form the supplier agreement between you and PIERRE MOUCHAN, an entrepreneur individuel (EI) operating as Obsibrain from 77 rue de Lagny, 75020 Paris, France. Contact: contact@obsibrain.com.

Polar Software, Inc. acts as merchant of record and authorized reseller for checkout, payment, taxes, invoices, and transaction support. Polar Buyer Terms govern the purchase transaction. These terms govern your Obsibrain license, product access, support, updates, and community access.

Obsibrain is a productivity plugin and supplied vault system for Obsidian. It connects tasks, projects, goals, notes, habits, templates, dashboards, and reviews. Obsibrain is independent from Obsidian and is not endorsed by Obsidian.

You must be at least 18 years old or have valid permission from a parent or legal guardian. You accept these terms when you purchase, download, activate, or use Obsibrain.

One license belongs to one named purchaser. You receive a personal, non-exclusive, non-transferable license to use Obsibrain on unlimited personal devices and vaults that you own or control.

You can use Obsibrain for personal work and your own internal business or client work. Each teammate, client, or other user needs a separate license. You cannot share license keys, sublicense, resell, redistribute, publicly host, or provide Obsibrain files to another person.

You retain ownership of your notes, Markdown files, metadata, templates, folders, and other content. You can adapt those materials for your own work. Obsibrain code, bundled assets, brand, and proprietary product materials remain protected and cannot be redistributed.

Access is delivered digitally. Installation requires a supported Obsidian version, community-plugin permission, your purchase email, and your license key. Initial activation requires an internet connection.

License state is local to each device. Obsibrain periodically revalidates the license and permits offline use for thirty days after the last successful validation. Without a valid license, product write actions enter read-only mode. Your Markdown files remain available.

The price displayed by Polar at checkout controls the transaction. Obsibrain is sold as a one-time purchase unless checkout expressly states otherwise. Later price changes do not affect completed purchases. Polar handles applicable transaction taxes and invoices.

Lifetime updates include every update released for Obsibrain while the product remains actively maintained and distributed. No additional license fee applies. If Obsibrain is discontinued, you retain access to the latest version delivered to you. This promise does not guarantee a maintenance period, perpetual third-party compatibility, or access to separately sold products.

You can request a full refund for any reason within 30 calendar days after purchase. Submit the purchase email and license key through the refund page. A completed refund revokes the associated license and Discord access. This commercial guarantee does not limit statutory consumer rights.

Purchase includes access to the Obsibrain Discord community while that community operates. Discord terms and community rules apply. Serious misconduct can result in community removal without terminating a valid software license. Community availability is not guaranteed indefinitely.

AI Alpha is optional, desktop-only, and not required for core workflows. After your consent, prompts and selected vault excerpts can reach your chosen provider through Pi. Provider terms, fees, retention, and privacy practices apply. AI output can be incomplete or wrong and must be verified.

Obsibrain requires Obsidian and supported operating systems. Optional synchronization, AI providers, Discord, and other external services have separate terms and costs. We do not guarantee compatibility with every future Obsidian version, operating system, theme, plugin, or external service.

Documentation, email support, and Discord community access are included. Unless separately agreed in writing, support has no guaranteed response time or service-level commitment.

We can suspend or terminate access for material breach, fraud, unlawful use, chargeback or refund, license-key sharing, or prohibited redistribution. We will provide notice and a reasonable opportunity to cure when appropriate. Immediate action remains possible for fraud, security threats, legal requirements, or serious abuse.

Mandatory consumer rights remain unaffected. French and European consumers receive the legal conformity protections applicable to digital content, including required conformity updates and available remedies for qualifying defects.

Any loss of a statutory withdrawal right for immediate digital delivery requires the checkout process to obtain the consent and acknowledgment required by applicable law. The unconditional 30-day refund remains available regardless of that separate statutory question.

Obsibrain is supplied without a promise of uninterrupted or error-free operation. Maintain backups before installation, migration, customization, or updates. Nothing in these terms excludes liability or remedies that applicable law does not permit us to exclude, including mandatory consumer protections, fraud, or personal injury.

French law governs these terms. If you are a consumer, this choice does not remove mandatory protections granted by the law of your habitual residence. Courts have jurisdiction under applicable consumer-protection rules.

We can update these terms for future purchases or necessary product, legal, or security changes. Material changes will receive reasonable notice and will not retroactively remove rights attached to a completed purchase.
